1. Acceptance of Terms

By accessing and using Epubly ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

2. Service Description

Epubly provides AI-powered book translation services. We use advanced language models from Google Gemini and OpenAI to translate books in EPUB, PDF, and TXT formats. The service operates on a credit-based subscription model with monthly character limits.

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information
  • You must be at least 13 years old to use the service
  • One account per person; sharing accounts is prohibited
  • You are responsible for maintaining account security

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the service. You may delete your account at any time through your profile settings.

4. Subscription and Credits

4.1 Credit System

  • Credits are measured in characters (not words or pages)
  • Credits refresh at the start of each billing cycle
  • Unused credits do not roll over to the next month
  • Credits are deducted based on source text length, not translated length

4.2 Subscription Plans

  • Starter: 400K characters/month
  • Pro: 2.5M characters/month
  • Business: 6M characters/month
  • Enterprise: 23M characters/month

All subscriptions are billed monthly and renew automatically until cancelled.

4.3 Payment

  • Payments are processed securely via Paddle
  • Prices are in USD and subject to change with notice
  • Failed payments may result in service suspension
  • You can cancel your subscription at any time

5. Acceptable Use

5.1 You May

  • Translate books you own or have permission to translate
  • Use translations for personal or commercial purposes
  • Download and keep your translated files

5.2 You May Not

  • Upload copyrighted material without permission
  • Violate intellectual property rights
  • Use the service for illegal purposes
  • Attempt to reverse engineer or hack the service
  • Upload malware, viruses, or malicious code
  • Abuse, harass, or spam our support team
  • Resell or redistribute our service
  • Use automated scripts to abuse the service

6. Copyright and Intellectual Property

6.1 Your Content

You retain all rights to the books you upload and the translations we generate. By using our service, you grant us a temporary license to process and store your content for the purpose of providing translation services.

6.2 Your Responsibility

You are solely responsible for ensuring you have the legal right to translate any content you upload. Epubly is not liable for copyright infringement resulting from your use of the service.

6.3 Our Service

The Epubly service, including its design, code, algorithms, and branding, is owned by us and protected by copyright and other intellectual property laws.

7. Translation Quality

While we use state-of-the-art AI models, translations are provided "as is" without guarantee of perfect accuracy. Quality may vary based on:

  • Source language complexity
  • Target language availability
  • Content type and formatting
  • Technical terminology

We recommend reviewing translations before publishing or distributing them.

8. Data Storage and Deletion

  • Uploaded files are automatically deleted after 24 hours
  • Translated files are automatically deleted after 24 hours
  • Download your files before the 24-hour expiration
  • We cannot recover expired files
  • Translation history is retained for 90 days

9. Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. The service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Third-party service outages (Firebase, AI providers)
  • Technical difficulties
  • Force majeure events

We will notify users of scheduled maintenance when possible.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Epubly is not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not responsible for data loss; please backup important files
  • We are not liable for copyright infringement by users
  • We are not responsible for third-party service failures

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify and hold Epubly harmless from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.

13. Governing Law

These terms are governed by the laws of the jurisdiction in which Epubly operates. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.

14. Changes to Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We may also change subscription pricing with 30 days advance notice to existing subscribers.
